South Africa: Court decision soon on Koeberg dispute

Judge Zeenat Carelse is expected to make a judgement soon in a case brought by Westinghouse Electric Company, challenging the award by Eskom on 12 August 2014 of a R4.2bn contract to France’s Areva to replace six steam generators at the Koeberg nuclear power plant. A three-day hearing in the high court in Johannesburg concluded on 19 February. Westinghouse claims that the decision was irregular as the board tender committee was “not entitled to introduce certain subjective ‘strategic considerations’ at the last moment or ignore, without good grounds, the recommendations of Eskom’s experts – who preferred Westinghouse’s cheaper bid”.
